Overview
Welcome to The Crafty Shaw. The terms “The Crafty Shaw,” “we,” “us,” and “our” refer to The Crafty Shaw. We operate this website and online store, including the information, content, features, products, digital products, tools, and services made available through it.
Our store is hosted by Shopify, which provides the e-commerce platform that allows us to offer our products and services to you.
These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies posted on our website, govern your access to and use of our website and your purchase of products from The Crafty Shaw.
By visiting our website, submitting an order, or purchasing a product, you agree to these Terms. If you do not agree, you should not use our website or purchase our products.
Nothing in these Terms limits any consumer right that cannot legally be waived.
1. Eligibility and Customer Information
By using our website, you confirm that you are at least the age of majority in your state or jurisdiction or that you have permission from a parent or legal guardian.
You agree to provide complete, current, and accurate ordering, billing, personalization, payment, and shipping information.
You are responsible for:

Providing correct names, dates, wording, colors, sizes, photographs, and personalization instructions

Monitoring the email address used to place your order

Responding promptly when we request clarification or approval
We are not responsible for delays, delivery failures, or personalization errors caused by incorrect, incomplete, unclear, or outdated information supplied by the customer.
2. Products and Handmade Variations
Many of our products are handmade, personalized, engraved, printed, assembled, or finished individually.
Because of the handmade and customized nature of our work, minor variations may occur between:

Product photographs and finished products

Separate items within the same order
-
Screen colors and printed or physical colors
-
Material placement, pattern placement, engraving, texture, or finish

Decorative elements used in handmade products
These minor variations are not considered defects when the item otherwise matches the approved design, description, and personalization information.
Colors may appear differently depending on your screen, lighting, printer, material, coating, or device settings. We cannot guarantee that colors displayed electronically will appear exactly the same on the finished product.
Product photographs may include props, staging materials, or accessories that are not included unless expressly stated in the product description.
3. Personalized, Custom, and Made-to-Order Products
Personalized, customized, engraved, printed-to-order, made-to-order, and special-order products are created specifically for the customer.
Before submitting an order, you must carefully review all information, including:

Product quantities

Shipping information
The information entered or submitted with the order will be treated as the information the customer intends us to use.
We are not responsible for errors that appear on a finished product when those errors were included in the information supplied or approved by the customer.
Personalized and custom products are final sale and are not eligible for return, exchange, cancellation, or refund except when:

We made an error that differs from the information submitted or approved by the customer;

The product arrived damaged;

The customer received the wrong product; or
-
A refund or other remedy is required by applicable law.
4. Design Proofs and Customer Approval
Some custom orders may include a digital design proof before production.
When a proof is provided, the customer is responsible for reviewing:

Spelling
-
Grammar
-
Dates
-
Names
-
Colors
-
Images
-
Placement
-
Sizing
-
Overall design details
Approval may be provided by email, text, direct message, online form, or another written communication method accepted by The Crafty Shaw.
Once a proof has been approved, production may begin immediately. The approved proof will control, even if the customer later discovers an error that was visible in the approved design.
Changes requested after approval may:

Be unavailable;
-
Delay the production timeline; or
-
Require an additional design, material, or rush fee.
If a customer does not respond to a proof or clarification request, the order may be placed on hold. Production and shipping timelines do not continue while we are waiting for required customer information or approval.
We will not intentionally proceed with an unclear personalized order when essential information is missing.
5. Customer-Submitted Photos, Artwork, Names, and Content
When you provide a photograph, logo, design, character image, wording, name, likeness, or other content for use on a product, you confirm that:

You own the content or have permission to use it;
-
You have permission to reproduce the image or likeness of any identifiable person shown;
-
Your requested use does not violate another person’s copyright, trademark, privacy, publicity, or other legal rights; and
-
The content is not unlawful, threatening, hateful, defamatory, obscene, or otherwise prohibited.
You grant The Crafty Shaw a limited right to use the submitted content solely as reasonably necessary to prepare, produce, revise, and fulfill your order.
We reserve the right to decline or cancel an order containing content that we reasonably believe is unlawful, infringing, offensive, unsafe, or inappropriate.
The customer is responsible for claims arising from content the customer supplied without the necessary rights or permission.
6. Character-Themed and Inspired Products
Some products may be created using a theme, color palette, or customer-provided inspiration.
Unless expressly stated otherwise, The Crafty Shaw is not affiliated with, sponsored by, endorsed by, or officially connected to any third-party character owner, entertainment company, sports organization, school, brand, or trademark holder.
Customers requesting the use of submitted logos, characters, photographs, or other protected material are responsible for having any necessary permission to use that material.
We reserve the right to decline a request involving third-party intellectual property.
7. Orders and Order Acceptance
Submitting an order constitutes an offer to purchase. An automated order confirmation only acknowledges that we received the order; it does not guarantee acceptance.
We may decline, limit, hold, or cancel an order for reasons including:

Suspected fraud or unauthorized payment

Incorrect pricing or product information
-
Material or inventory unavailability
-
An inability to complete the requested customization
-
Missing personalization information
-
Prohibited or infringing content
-
Shipping restrictions
-
Safety concerns
-
Abusive, threatening, or fraudulent customer conduct
When we cancel an order before production because we cannot fulfill it, we will issue any refund required for the unfulfilled portion of the order.
8. Cancellations and Changes
Because personalized items may enter design or production shortly after an order is placed, cancellation and change requests are not guaranteed.
A customer should submit a requested cancellation or change as soon as possible by emailing shorna@thecraftyshaw.com.
An order cannot be cancelled after:

Production has begun;
-
Materials have been specially ordered or cut;
-
A design proof has been approved;
-
Personalization has been printed, engraved, pressed, assembled, or otherwise applied; or
-
The order has shipped.
If we approve a cancellation before production begins, any nonrefundable design, consultation, rush, or processing fee disclosed at the time of purchase may be deducted where permitted by law.
Changes that require additional design work, materials, labor, or production time may result in an additional charge.
9. Pricing, Payments, Deposits, and Fees
All prices are displayed in U.S. dollars unless otherwise stated.
Prices, product availability, promotions, and discounts may change without notice. The price charged will be the price displayed when the order is submitted, subject to the correction of genuine errors.
The customer agrees to pay all applicable:

Product charges

Personalization charges
-
Design fees
-
Rush fees
-
Shipping and handling charges
-
Taxes
-
Customs duties or import charges
Certain custom orders may require a deposit. When a nonrefundable deposit is disclosed before payment, the deposit compensates us for reserved production time, design work, materials, and preparation.
A remaining balance must be paid by the stated deadline. We may pause production or withhold delivery or shipment until the full balance has been received.
Rush fees pay for priority processing and do not guarantee a carrier’s delivery date.
10. Pricing Errors
We reserve the right to correct typographical, technical, or pricing errors.
If a significant pricing error affects an order, we may:

Contact the customer for approval of the corrected price; or
-
Cancel the affected item and issue a refund.
We will not charge a corrected higher price without the customer’s approval.
11. Production and Processing Times
Processing time is the time required to design, create, prepare, and package an order. It is separate from shipping transit time.
Any production or processing timeframe is an estimate unless we expressly state that it is guaranteed.
The processing period begins only after we have received:

Required payment or deposit;
-
Complete personalization information;
-
Usable photographs or artwork;
-
Any requested measurements; and
-
Final proof approval, when applicable.
Customer response delays, proof revisions, address problems, material shortages, high-volume periods, and requests for order changes may extend the processing time.
If we determine that we cannot ship an order within the timeframe promised or otherwise required, we will contact the customer regarding the delay and provide the options required by applicable law.
12. Shipping and Delivery
Delivery dates are estimates unless expressly guaranteed in writing by The Crafty Shaw.
We are not responsible for carrier delays caused by weather, transportation interruptions, customs, incorrect addresses, natural disasters, service disruptions, or other conditions outside our reasonable control.
However, we will comply with applicable requirements concerning delayed shipment, order cancellation, and refunds.
The customer is responsible for providing a secure and complete delivery address.
If an order is returned because of an incorrect address, refused delivery, an unclaimed package, or another customer-related delivery issue, the customer may be responsible for additional shipping costs before the order is resent.
Personalized items returned to us as undeliverable are not automatically eligible for a refund.
13. Missing, Stolen, or Misdelivered Packages
When tracking shows that an order was delivered but the customer cannot locate it, the customer should:

Check the delivery location carefully;
-
Ask household members, neighbors, building staff, or mailroom personnel;
-
Allow a reasonable period for an early delivery scan to update; and
-
Contact the shipping carrier when appropriate.
The customer must notify us promptly so that we can review the tracking information and determine what assistance or carrier claim may be available.
We do not guarantee reimbursement for packages that carrier tracking confirms were delivered to the address supplied by the customer. However, we will review each claim fairly and comply with applicable law and carrier requirements.
The Crafty Shaw is not responsible for theft occurring after proper delivery.
14. Damaged, Defective, or Incorrect Orders
Customers must inspect their order promptly after delivery.
Claims concerning transit damage, defects, missing items, or incorrect items should be submitted to shorna@thecraftyshaw.com within 24 hours of the carrier-recorded delivery time.
The claim should include:

The customer’s name
-
The order number
-
A description of the issue
-
Clear photographs of the product
-
Clear photographs of the shipping container
-
Photographs of the packaging materials and shipping label
-
A photograph showing the entire affected item
The customer must keep the product, packaging, and shipping materials until the claim has been resolved.
After reviewing the claim, we may provide an appropriate remedy, which may include:
-
Repair;
-
Replacement;
-
Reproduction of the affected item;
-
Store credit; or
-
A refund when required by law or when another remedy is unavailable.
We may request that an incorrect or damaged item be returned before issuing a replacement or other resolution. Return instructions must be followed, and unauthorized returns may not be accepted.
A customer’s failure to report visible transit damage within 24 hours may affect our ability to verify the claim or seek recovery from the carrier. This reporting period does not eliminate any non-waivable legal rights.
15. Returns, Exchanges, and Refunds
Returns, exchanges, replacements, credits, and refunds are governed by our separate Refund Policy, which is incorporated into these Terms.
Personalized, customized, made-to-order, engraved, and special-order products are final sale except when defective, damaged, incorrect, or otherwise eligible for a remedy under applicable law.
Non-personalized merchandise may qualify for the remedy described in our Refund Policy.
Products may not be returned without prior written authorization.
16. Digital Products and Downloads
Digital products are delivered electronically. No physical product will be shipped unless the product listing expressly states otherwise.
Because digital products cannot be physically returned, digital products are final sale once they have been delivered, downloaded, accessed, or emailed, except when:

The wrong file was provided;
-
The file is corrupted or unusable;
-
The file materially differs from the product description; or
-
A refund is required by applicable law.
The customer is responsible for confirming software, file-type, device, printer, and platform compatibility before purchasing.
Differences caused by a customer’s printer, ink, paper, cutting machine, software, device, screen, or technical skill are not considered product defects.
17. Digital Product License
Unless a product listing provides a different written license, digital products purchased from The Crafty Shaw are licensed—not sold—for the purchaser’s personal use or limited small-business use as stated in the listing.
The customer may not:

Resell, redistribute, share, transfer, or give away the digital file;
-
Upload the file to a shared drive, membership platform, or digital marketplace;
-
Claim the design as their own;
-
Convert the file into another digital format for resale;
-
Sell or distribute editable versions of the file;
-
Use the file as part of a competing digital bundle; or
-
Make the file available for others to download.
Permission to use a design on physical finished products does not include permission to resell or distribute the underlying digital file.
All rights not expressly granted remain with The Crafty Shaw or the applicable rights holder.
18. Product Safety and Intended Use
Customers are responsible for using products only for their intended purpose and following any instructions or warnings included with the product.
Small parts, keychains, jewelry, magnets, decorative accessories, packaging, and party-favor components may present choking or other hazards to young children.
Unless expressly identified as a children’s toy, products should not be treated as toys. Adult supervision may be required.
Food, beverages, candy, cosmetics, paint, adhesive products, or other third-party items included in a bundle remain subject to the manufacturer’s ingredients, warnings, expiration dates, instructions, and allergy information.
Customers should review manufacturer packaging before use. The Crafty Shaw does not manufacture third-party food, beverage, cosmetic, or branded supply items included in a finished bundle.
19. Promotions, Discounts, and Gift Cards
Promotions and discount codes:

Must be used during the applicable promotional period;
-
Cannot be applied retroactively;
-
Cannot be combined unless expressly permitted;
-
Have no cash value; and
-
May be limited by product, quantity, customer, or order.
Gift cards and store credits are not redeemable for cash except where required by law.
Sale and clearance products may be final sale when clearly identified as such before purchase.
20. Intellectual Property
The website and its original content—including The Crafty Shaw’s name, logos, photographs, videos, graphics, written descriptions, original designs, templates, downloads, and website layout—are owned by or licensed to The Crafty Shaw and are protected by applicable intellectual-property laws.
You may not copy, reproduce, republish, distribute, modify, scrape, sell, license, or commercially exploit our website content without prior written permission.
Purchasing a physical product does not transfer ownership of the underlying artwork, design, photography, template, or intellectual property.
21. Customer Reviews, Photos, and Feedback
When you voluntarily submit a review, testimonial, photograph, video, social-media tag, suggestion, or other feedback, you confirm that you have the right to submit it.
You grant The Crafty Shaw permission to reproduce and display that submitted content for reasonable business and promotional purposes unless you clearly request otherwise in writing.
We will not intentionally publish sensitive payment or account information.
For custom-order photographs supplied only for production, the limited-use terms in Section 5 apply unless the customer separately authorizes promotional use.
22. Acceptable Use
You may not use our website or services to:

Violate any law;
-
Commit fraud;
-
Submit unauthorized payment information;
-
Infringe intellectual-property or privacy rights;
-
Upload malicious software;
-
Scrape or harvest website data;
-
Interfere with website security;
-
Harass or threaten our staff, contractors, or other customers;
-
Submit knowingly false claims; or
-
Use our products or services for an unlawful purpose.
We may limit or terminate access when we reasonably believe these Terms have been violated.
23. Third-Party Services and Links
Our website may contain integrations, links, payment services, shipping tools, or other features operated by third parties.
We do not control those third-party services and are not responsible for their independent content, availability, policies, or practices.
Customers should review a third party’s terms and privacy practices before using its services.
24. Shopify
Our store is hosted by Shopify. Purchases made through the store are transactions directly between the customer and The Crafty Shaw.
Shopify provides the e-commerce platform but is not the seller of The Crafty Shaw products and is not responsible for producing, personalizing, fulfilling, or delivering our products.
25. Privacy
Our collection and use of personal information are governed by our Privacy Policy.
Customer information may be shared with service providers such as Shopify, payment processors, shipping carriers, email providers, and other vendors when reasonably necessary to operate the store and fulfill orders.
26. Disclaimer of Warranties
To the fullest extent permitted by law, the website and services are provided on an “as available” basis.
We do not guarantee that the website will always be uninterrupted, secure, or error-free.
Nothing in this section excludes warranties or consumer protections that cannot legally be disclaimed.
27. Limitation of Liability
To the fullest extent permitted by law, The Crafty Shaw will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or products.
Where liability cannot be excluded, our total liability relating to a particular order will not exceed the amount the customer paid for the product giving rise to the claim, except when applicable law requires otherwise.
Nothing in these Terms limits liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or any other non-waivable legal obligation.
28. Indemnification
To the extent permitted by law, you agree to indemnify and hold The Crafty Shaw harmless from third-party claims arising from:

Content, photographs, logos, designs, or instructions you supplied;
-
Your violation of another person’s intellectual-property, privacy, or publicity rights;
-
Your unlawful use of the website or products; or
-
Your material breach of these Terms.
This section does not require a consumer to indemnify The Crafty Shaw for our own negligence, wrongful conduct, or violation of law.
29. Governing Law
These Terms are governed by the laws of the State of New Jersey and applicable federal law, without regard to conflict-of-law principles.
Any legal proceeding concerning these Terms will be brought in a court with lawful jurisdiction over the dispute.
Nothing in this section deprives a consumer of a legal protection that applies in the consumer’s place of residence and cannot lawfully be waived.
30. European Union and Other International Consumer Rights
If we sell and ship eligible products to a customer in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protections, those protections will apply where legally required.
Cooling-off or change-of-mind rights may not apply to:

Clearly personalized goods;
-
Custom-made goods;
-
Goods made to the customer’s specifications;
-
Unsealed or accessed digital content when the customer validly consented to immediate delivery and loss of the withdrawal right; or
-
Other legally exempt products.
Personalized-product exclusions do not eliminate legal remedies for products that are faulty, damaged, materially misrepresented, or not supplied as agreed.
31. Severability
If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted or removed, and the remaining provisions will continue in effect.
32. No Waiver
Our failure to enforce a provision of these Terms on one occasion does not waive our right to enforce it later.
33. Entire Agreement
These Terms and the policies incorporated into them constitute the agreement between the customer and The Crafty Shaw concerning use of the website and purchases made through it.
Product-specific terms displayed on a product page or custom invoice also apply. When product-specific terms conflict with these general Terms, the more specific terms will control to the extent permitted by law.
34. Changes to These Terms
We may update these Terms by posting a revised version on our website.
Changes will apply prospectively from the effective date displayed at the top of the revised Terms unless applicable law requires otherwise.
The version in effect when an order was placed will generally govern that transaction.
